*HINAGAR: The Justice Nanavati commission report gave a clean chit to chief minister Narendra Modi, his council of ministers and police officers while calling the burning of S-6 coach on February 27, 2002, at Godhra a "conspiracy".

The report on the carnage that killed 59 people, mainly Hindu activists, absolved the Modi administration of any lapse in providing "protection, relief and rehabilitation to the victims of the communal riots".

The report on the carnage, which trigerred statewide riots that left more than 1,000 people dead, was tabled in the Gujarat assembly on Thursday amid a walkout by the Congress and cheers from BJP MLAs.

Six-and-a-half years after it was set up, retired Supreme Court judge, Justice G T Nanavati, who probed the anti-Sikh riots of 1984 not only agreed with the government view that the incident was the outcome of a conspiracy but also said, "It was a part of a larger conspiracy to create terror and destablise the administration."

Relying mainly on the investigations by the Special Investigation Team (SIT) set up by Modi, and headed by inspector-general of police Rakesh Asthana, the commission also absolves the kar sevaks.

The commission says at one point, "The kar sevaks had not done anything and no incident had happened earlier which could have led to the incident which later on happened at Godhra."

The Godhra carnage also led to Gujarat's first Pota case, which booked 131 accused of whom two died in judicial custody and some are out on bail. Two prime accused, Salim Panwala and Farukh Bhana, are absconding and presumed to be in Pakistan.

Based mainly on the Gujarat Forensic Science Laboratory reports and statements recorded by the SIT, the commission holds Maulvi Hussain Umarji of Godhra as the mastermind of the incident.

Justice Nanavati completely dismisses the theory that a Muslim girl was attacked on Godhra railway platform provoking the attack on the train. He says, "Because the train was running late, they had to make some changes in tier plan and circulate a false rumour regarding abducting of a Ghanchi Muslim girl.

That was done in order to collect large number of persons near the train and induce them to attack it, so that they get sufficient time to go near the train with petrol."

Justice Nanavati also asserts that "the train did not stop on its own but it was made to stop by pulling the alarm chain from outside", thus disputing claims that the chain was pulled from inside to stop the train.

but why would a crowd want to do that? that is the big question for me.
this is not a random terrorist strike. if this was a calculated act then it makes no sense since it would have only led to more violence and arrests for the perpretators, that much would be obvious to anybody. an open, unprovoked act of violence of such large proportions seems to ask for a motivation. i can understand if there is a stray stone-throwing event that happens, or two mobs fighting it out. but this was single-minded and purposeful like a terrorist attack according to the commission. so if this was a terrorsist attack then why do it so openly and blatantly when a couple of bombs in the market would  have got the population gripped in fear. this did not spread any fear. in fact it had the opposite effect and this too, at that time, would have been obvious to the leaders of the mob. also there were no known terror groups in operation in gujarat (or were sleeper at the most) in those years.

there have been many such trains and buses and bullock carts in the past too, and the muslim community knows better than to mess with this possible communal bomb

AHMEDABAD: Would the Sabarmati express have met the same fate had someone aboard it not pulled the chain to allow the kar sevaks in, just after it left the Godhra platform? Or for that matter, would the S-6 coach have burnt had the desperate passengers, or someone outside, not opened the door?

The fire on the S-6 coach which claimed 59 lives, mostly of kar sevaks on February 27, 2002, sparking state-wide riots only raised more questions before the Nanavati-Shah commission which concluded its hearing on the Godhra carnage on Friday.

Through carefully juxtaposed excerpts from testimonies of witnesses recorded before the commission and police chargesheet, rights group Jansangharsh Manch (JSM) which has challenged the state government's conspiracy theory, concluded that there was no second chain pulling at Godhra that day.

Comparing Sabarmati express with Samjhauta express fire, JSM advocate Mukul Sinha said, "Before even considering that 140 litres of petrol was used to burn S-6, the prosecution should consider that barely half a litre of kerosene was used to blast Samjhauta!"

Rebutting the state government's conspiracy theory, Sinha told the commission that had the said molestation of the Muslim girl near the Godhra parcel office and the fracas between the railway station vendors and the kar sevaks not occurred, no crowd would have collected to pelt stones at the train. "The prosecution is trying to explain what is natural (the collecting of a crowd) in an unnatural (collecting a crowd was part of the conspiracy) manner", he said.

Corroborating testimonies of the train driver, Rajendra Rao Yadav, assistant station manager Harimohan Meena, guard Satyanarayan Verma and Sadhvi Meenakshi Devi, Sinha told the commission that the chain was pulled only once, to let in the kar sevaks. This caused a vacuum drop in five coaches of which four were set right. "The one which was not, caused the train to drag till about 800 metres which incidentally is till the 'A' cabin, where the incident occurred", said Sinha.

Sinha conducted a 'session' on physics to prove that only 100 litres of petrol thrown on the floor of the coach would push the temperature to 1000 degrees within two seconds and ignite the whole coach killing everybody. In the Godhra fire, however, passengers had some time to escape.

He objected to government pleader Sunit Shah's earlier position on the WTC attack and alleged he had reversed the order by showing the smoke on the tower as preceding the flames.

In a video recap of the incident, he showed how the plane hit the tower, leading to a fire and then smoke.

There are two conflicting reports out there ... one each for respective supporters ... depending on what you want to hear. I obviously have no clue about what happened ...nor can anyone else who was not directly involved - of course, one can always choose what one wants to hear or believe.

But this statement above is a problem as far as I am concerned. How can one use the findings of a team that was set up by the chief minister & the head of the police force (who were among the main parties accused) to give these same guys a clean chit?

Isn't there a single supreme court appointed committee out there to investigate this?

the whole thing is very murky and difficult to make out your opinion and this is a dangerous precedent. In future, what if the politicians does this for every incident?

One of the justices is selling his soul shamelessly using the bodies on that godhra train.

It turns out that there is. A Supreme Court appointed SIT has officially begun investigations into the entire Gujarat riots including the Godhra incident.

This is good news. An impartial enquiry will be good for everyone including those accused who are not guilty.
