In so far as the mocking tone used by Hayden to mimic how Indians speak is used derogatorily and as a marker of identity, shouldn't this also qualify as racism? In which case, shouldn't the ICC be acting peremptorily rather than wait for the BCCI lodge a protest? Would k-i-c care to explain?

Whether it is racist or not is arguable, generally speaking.
But given the standards that have been defined to judge racism this cricketing season down under, the mocking tone of the comments with the emphasis on poor diction, pronunciation and language usage in Hayden's mimicry leaves it very much open to be judged as racism --making fun of an accent of a non native English speaker.
Remember, racism is about perception and given the standards as set by monkeygate, this line of argument flies just as well.
